Pursuant to Article 391 Paragraph 1 of the Act on Ownership and Other Real Rights (The Official Gazette of the Republic of Croatia no. 91/96., 68/98., 137/99., 22/00., 73/00., 114/01., 79/06., 141/06., 146/08., 38/09. and 153/09.) the Prefect of the County of Međimurje announces
1. Subject of the Invitation:
1.1 Subject of the Invitation is a sale of a part of the property in the area of the business zone „Međimurje Business Park“in Čakovec registered at the Municipal Court in Čakovec, land registry sheet no. 4404., cadastre municipality Čakovec:
1. land registry plot 1134/53/8 (cadastral plot 1700/11) by nature a pastureland in Bana Josipa Jelačića Street, overall surface area of 10,359 m2 – the initial bidding price EUR 264.154,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,
2. land registry plot 1134/53/9 (cadastral plot 1700/12) by nature a pastureland in Bana J. Jelačića Street, overall surface area of 9,060 m2 – the initial bidding price EUR 231.030,00 payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,
3. land registry plot 1134/53/10 (cadastral plot 1700/13) by nature a pastureland in Bana J. Jelačića Street, overall surface area of 9,640 m2 – the initial bidding price EUR 245.820,00 payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,
4. land registry plot 1134/53/12 (cadastral plot 1700/15) by nature a pastureland in Bana J. Jelačića Street, overall surface area of 10,235 m2 – the initial bidding price EUR 260.992,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,

Jelačića Street, overall surface area of 9,005 m2 – the initial bidding price EUR 229.627,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,

Jelačića Street, overall surface area of 9,721 m2– the initial bidding price EUR 247.885,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,

Jelačića Street, overall surface area of 9,613 m2 – the initial bidding price EUR 245.131,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,

Jelačića Street, overall surface area of 8,729m2 – the initial bidding price EUR 222.589,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,

Jelačića Street, overall surface area of 9,007 m2 – the initial bidding price EUR 229.678,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,

Jelačića Street, overall surface area of 9,003 m2 – the initial bidding price EUR 229.576,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,
13. land registry plot 1134/53/25 (cadastral plot 1700/28) by nature a pastureland in Bana J. Jelačića Street, overall surface area of 10,393 m2 – the initial bidding price EUR 265.021,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,
14. land registry plot 1134/53/26 (cadastral plot 1700/29) by nature a pastureland in Bana J. Jelačića Street, overall surface area of 9,920 m2 – the initial bidding price EUR 252.960,00, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,
15. land registry plot 1134/53/27 (cadastral plot 1700/30) by nature a pastureland in Bana J. Jelačića Street, overall surface area of 11,765 m2 – the initial bidding price EUR 300.007,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment,
16. land registry plot 1134/53/28 (cadastral plot 1700/31) by nature a pastureland in Bana J. Jelačića Street, overall surface area of 7,253 m2 – the initial bidding price EUR 184.951,50, payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment.
1.2. Use and purpose of the property is set in the Detailed Urban Plan of the zone East – northern part of the City of Čakovec ("The Official Gazette of the City of Čakovec" no. 1/11).
2. Conditions for purchase of the property:
Participation in bidding is open to all citizens of the Republic of Croatia and legal persons registered in the Republic of Croatia as well as foreign (natural and legal persons) provided they comply with legal provisions for acquiring the right of ownership in the Republic of Croatia.
3. The initial property bidding price and a bid security:
3.1 The initial bidding price for property listed in Paragraph 1. is EUR 25.50 per 1m2 in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment. A bidder may make a bid for a single, several or all land registry plots (cadastral plots) in Paragraph 1 of this Invitation. In the event of making a bid for several land registry plots, a price for each land registry plot must be indicated separately.
3.2 Interested bidders are required to furnish a bid security in the amount of EUR 12,500.00 (payable in HRK counter value according to the middle exchange rate of the Croatian National Bank on the day of payment). The bid security shall be paid into the business account in Privredna banka Zagred d.d, no: 2340009-1800020004, payment code no. 68 7340 – PERSONAL IDENTIFICATION NUMBER (OIB) (for legal and natural persons), payment purpose: „Jamčevina za kupnju nekretnine POSLOVNI PARK MEĐIMURJE“. Bid securities furnished by bidders who have not been selected shall be released within 8 days as of the day of the selection of the most successful bidder, in its nominal amount without interest, while the amount of bid security shall be calculated towards purchase price as far as the successful bidder is concerned.
The bidder who fails to sign the contract upon being chosen as the most successful bidder, or the bidder who fails to pay the whole sum of the purchase price within scheduled date, shall forfeit the right to the bid security retrieval.
4. Contents and enclosures to the bid
4.1. Name, surname, personal identification number (OIB) and address of the bidder (if natural person), i.e. company name, personal identification number (OIB) and company registered location (if legal person);
4.2. Copy of an identity card, certificate of registration at the company/crafts register (foreign legal persons can submit any other certificate proving the status of the legal person);
4.3. Proof of the bid security payment, bidder’s account number and the name of a bank to which the bid security shall be returned;
4.4. Indication of land registry plot/s (cadastral plot/s) for which a bid is made, the amount of bidding price (in numbers and in words) and deadline for payment;
4.5. Balance sheet, profit and loss account or equivalent financial statements for year 2011;
4.6. Binding letter of intention of a commercial bank confirming that the bank shall issue a bank guarantee with a clause “on first call and without reclamation” for the amount equal to 10% of the bidding price, reduced by the amount of the furnished bid security, as the security to the County, for fulfilling of contractual obligations of in case of contract agreement with the bidder;
4.7. Business-investment study for the first five years as of the date of signature of the contract stating the date of commencement of construction works (see Paragraph 5);

5. A basic criterion for property purchase is the highest bidding price. In the event of receiving two or more bids with equal price, preferred bidder will be the bidder who shall receive the highest number of scores for the Business-investment study, i.e. Plan of development and utilization of property for first 5 years starting from signing the contract, and in which the date of commencement of construction works is stated. The following criteria shall be examined:
5.1. Compatibility of the Study/Plan from Paragraph 5 of this Invitation for first five years starting from signing the contract, and in which the date of commencement of construction works is stated, with the priorities of the Development Strategy of Međimurje County 2011-2013 (“The Official Gazette of the Međimurje county” no. 3/11),
5.2. Description of purpose and type of future business activities within the area of the business zone,
5.3. Description of further intentions of buyer for commercialization of the area (potentials for involving local economy in procurement chain of bidders and/or future investors, investment intentions of bidders and/or future investors in research and development, share of investments of bidders and/or future investors in development and education of employees in total year salary expenditures, share of high educated employees in total number of employees at bidders and/or future investors),
5.4. Planned total number of employees,
5.5. Share of high educated labour force in planned employment,
5.6 Proposed payment model.

6. A bidder must submit the written bid along with the enclosures in a sealed envelope to the following address: Međimurska županija, Ruđera Boškovića 2, 40 000 Čakovec specifying the bid reference: “Ponuda za kupnju nekretnina – POSLOVNI PARK MEĐIMURJE“. Bids must be received by the deadline, 15th March 2013 at 12.00 hrs, no matter what type of delivery is chosen. Late and incomplete bids shall be automatically rejected.
7. Selection of the most successful candidate shall be made by the Međimurje County Assembly at first subsequent session of the Assembly. The selected candidate must sign the purchase contract within 8 days as of the decision of the Assembly. Method and deadlines for payments, moment of property transfer shall be defined by the contract. Payment within deadline/deadlines and fulfilment of proposed business concept of the business zone development shall be an important term of the contract.
Property transfer tax and other costs related to transfer of ownership shall be borne by the buyer.
8. The seller reserves the right to reject all bids or to cancel this invitation to bid without any justification.
The property shall be sold on the principle of “seen-bought”, which excludes any retrospective complaints.
